1. Acceptance of Terms
By accessing or using Vergate ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Vergate provides website security scanning, vulnerability detection, performance analysis, technology profiling, SEO/AEO analysis, accessibility auditing, uptime monitoring, and third-party integration security analysis. The Service is provided "as is" and may be modified or discontinued at any time.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for safeguarding your password and API keys. You may not share your API keys publicly. One account per person or organization. You must be at least 16 years of age to use the Service.
4. Acceptable Use
You may only scan websites you own or have explicit authorization to test. Unauthorized scanning of third-party systems is illegal and strictly prohibited. You must not use the Service for any purpose that violates applicable laws or regulations, to attack, disrupt, or harm other systems, or to attempt to gain unauthorized access to any system.
5. Subscriptions and Billing
Polar is the Merchant of Record for all Vergate purchases. Polar processes payments, issues receipts and invoices, and handles billing, tax, and refund requests on our behalf. Prices are in USD and exclude applicable taxes. Subscriptions auto-renew unless cancelled. Free tier includes limited scans per month. Paid plans unlock active scanning, monitoring, and higher quotas. Subscriptions are generally non-refundable once monitoring, scans, or other paid resources have been consumed — using paid features constitutes delivery of the digital service; limited exceptions and our 14-day meaningful use review are described in our Refund Policy.
6. Intellectual Property
Vergate retains all rights to the Service, including its code, design, and documentation. You retain ownership of your scan data and results. You grant Vergate a limited license to process your data as necessary to provide the Service. Our engine is open-source; the hosted platform and brand are proprietary.
7. Data and Privacy
We collect and process data as described in our Privacy Policy. Scan targets, results, and credentials are encrypted at rest. We do not sell your data to third parties. You may export or delete your data at any time. See our Privacy Policy for full details.
8. Third-Party Integrations
When you connect third-party services (GitHub, Vercel, etc.), you authorize Vergate to access those services on your behalf. Credentials are encrypted with Fernet symmetric encryption. You may revoke integrations at any time. We are not responsible for third-party service availability or data practices.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We do not guarantee the Service will be uninterrupted, error-free, or completely secure. Security scans may not detect all vulnerabilities. Vergate is not a substitute for professional penetration testing or security auditing.
10. Limitation of Liability
To the maximum extent permitted by law, Vergate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
11. Termination
You may terminate your account at any time. We may suspend or terminate your access if you violate these terms. Upon termination, your data will be retained for 30 days then permanently deleted. Paid subscriptions may be cancelled through the billing portal.
12. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance. The latest version is always available at vergate.dev/terms.
